5. Residence permit for humanitarian reasons

  A residence permit for humanitarian reasons is issued in accordance with paragraphs 46 and 47 of Law No. 6458 on Aliens and International Protection. In addition, paragraph 44 of the Regulation on the Application of the Law "On Aliens and International Protection" refers to a residence permit for humanitarian reasons.


  Categories of foreign citizens who are issued a residence permit for humanitarian reasons

  - In the best interests of the child,

  - In the event that, despite the decision to ban entry into Turkey or deportation, foreign citizens continue to stay in Turkey or there is no possibility of their departure.

  - Unless a decision has been made to deport foreigners in accordance with paragraph 55 of the law.

  - When filing a lawsuit in a court of general jurisdiction against the provisions described in paragraphs 53, 72 and 77 of the law.

  - During the continuation of the clearance procedure related to the deportation of the applicant to the country of first asylum or return to a safe country for him.
  - In the event that there are reasons why foreign citizens who have the right to enter or stay in Turkey due to emergency or protection of national interests, or do not pose a threat to public order and security, do not have the opportunity to obtain one of the other residence permits.

  - In emergency situations, in the above situations, a residence permit is granted for humanitarian reasons.

  The period for which a residence permit can be issued for humanitarian reasons
  This residence permit is issued with the approval of the ministry in the governorate for a period not exceeding one year.

  To obtain a residence permit for humanitarian reasons, you do not need to meet the conditions necessary to fulfill when applying for other residence permits.

  Reasons for refusal to issue, annul or refuse to extend a humanitarian residence permit

  A humanitarian residence permit is issued with the approval of the ministry, in case of non-compliance with the mandatory conditions, the governorate has the right to cancel and refuse to renew such a permit.

 

  Other provisions regarding humanitarian residence permit
  Foreign citizens must, no later than 20 working days from the date of issue of the humanitarian residence permit, register their address of residence in the registration system.

  In case of meeting the conditions required for obtaining other residence permits, with the exception of a long-term residence permit, holders of a humanitarian residence permit can apply for one of them.
  Duration of stay for humanitarian reasons is not taken into account when calculating the total duration of residence permits provided for by law.
